By accessing or using the website at masonryankeny.com or by engaging Ankeny Concrete & Masonry ("we," "our," or "us") for masonry contractor services, you agree to be bound by these terms and conditions. If you do not agree to these terms, please do not use our website or services.
These terms apply to all visitors to our website and to all customers who engage us for services. We may update these terms from time to time. Continued use of our website or services after any update constitutes acceptance of the revised terms.
Ankeny Concrete & Masonry provides masonry and concrete contractor services including, but not limited to, foundation repair, chimney repair, tuckpointing, brick repair, retaining wall construction, fireplace installation, stone and brick work, walkway and driveway construction, and related services. We operate in Ankeny, IA and surrounding communities in the Des Moines metro area.
All services are subject to an on-site assessment. We reserve the right to decline any project that falls outside our scope of work or that we determine cannot be completed safely or to an acceptable standard.
Written estimates are provided free of charge following an on-site assessment. An estimate is not a binding contract until both parties have signed a written work agreement. Estimates are valid for 30 days from the date issued unless otherwise stated in writing.
Pricing may change if the scope of work changes after an estimate is issued. If we discover conditions during the job that require additional work not covered in the original estimate, we will notify you before proceeding and provide a revised written estimate for the additional work.
We do not provide binding quotes over the phone or by email without an in-person inspection. Any figures discussed prior to an on-site visit are estimates only and are subject to change.
Project start dates are scheduled by mutual agreement and are subject to availability, weather conditions, and material lead times. We will make reasonable efforts to meet the agreed start date but cannot guarantee exact scheduling due to factors outside our control, including weather delays common in central Iowa.
If you need to cancel or reschedule, please contact us as soon as possible. Cancellations made with fewer than 48 hours notice prior to a scheduled start date may be subject to a cancellation fee, as outlined in your written work agreement.
If we need to delay your project start date due to weather or other circumstances, we will contact you promptly to discuss rescheduling. No cancellation fee applies when we initiate a change.
Payment terms are specified in your written work agreement. In general, a deposit may be required prior to project start, with the remaining balance due upon completion of the work. We accept payment methods as stated in the work agreement.
All balances are due within the timeframe specified in the work agreement. Overdue balances may be subject to late fees. If a balance remains unpaid, we reserve the right to pursue collection through appropriate legal channels.
Title to any materials installed on your property passes to you upon receipt of full payment. Until payment is received in full, installed materials remain the property of Ankeny Concrete & Masonry.
For work that requires a building permit under local or state regulations, we will obtain the necessary permit before beginning structural work. The cost of required permits is either included in the estimate or identified as a separate line item. It is your responsibility to ensure that your property is legally available for the work and that any required homeowner association approvals are obtained before the project begins.
We warrant our workmanship against defects for the period stated in your written work agreement. This warranty covers defects in the work we performed and does not cover damage caused by events outside our control, including severe weather, acts of nature, improper maintenance, alterations made by others, or pre-existing conditions in your property that were not part of the scope of work.
Materials may carry a separate manufacturer warranty. We will pass through any applicable manufacturer warranty to you, but we make no additional representations about the performance of materials beyond what is stated in those manufacturer warranties.
The website and information on it are provided on an "as is" basis. We make no warranty that the website will be error-free or that any information on it is complete or current.
To the fullest extent permitted by law, Ankeny Concrete & Masonry shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to our services or your use of our website, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from services provided shall not exceed the amount paid by you for the specific work giving rise to that claim. Nothing in these terms limits liability for gross negligence, willful misconduct, or claims that cannot be limited by law.
We want to resolve any issue fairly and directly. If you have a concern about work we performed or a charge on your invoice, contact us first at hello@masonryankeny.com or (515) 963-5532. We will make a good-faith effort to address the issue within a reasonable time.
If a dispute cannot be resolved directly, both parties agree to pursue resolution through mediation before initiating any litigation. Mediation shall take place in Polk County, Iowa, unless otherwise agreed in writing.
These terms and conditions are governed by the laws of the State of Iowa, without regard to its conflict of law provisions. Any legal proceedings arising out of or related to these terms shall be filed in the appropriate courts located in Polk County, Iowa.
You may use our website for lawful purposes related to learning about or engaging our services. You may not use our website in any way that could damage it, interfere with other users, or violate any applicable law. We reserve the right to restrict access to our website at any time.
We reserve the right to modify these terms and conditions at any time. Updated terms will be posted on this page with a revised effective date. Your continued use of our website or services after a modification is posted constitutes your acceptance of the updated terms.
